Terms of Service

1. Overview

These Terms of Service ("Terms") govern all services provided by HV Podcasting ("we," "us," "our"), located at 320 Robinson Ave, Suite 212, Newburgh, NY 12550. By booking a session, purchasing a package, or using any of our services, you ("Client," "you") agree to these Terms in full.

2. Services Provided

HV Podcasting offers the following core services:

• Studio Recording: In-studio podcast recording sessions (up to 1 hour per session) with 3-angle 4K video, professional audio equipment, and an on-site engineer. Up to 2 guests are included per session; additional guests are $50 each (up to 4 total).
• 10-Episode Season: A bundle of 10 studio recording sessions with full post-production (filming and editing). One free episode is included when you commit to 10.
• Pod Launch: A startup package that includes an animated intro, animated outro, a landing page website, and setup of social media profiles (Facebook, Instagram, TikTok, YouTube, Spotify, and Apple Music). This package does not include recording sessions.
• Mobile Podcast: On-location recording within 25 miles of our Newburgh studio is included in the base price. Travel beyond 25 miles requires the Client to cover travel expenses.
• Audiobook Recording: Hourly studio sessions for audiobook recording, including editing of the recorded audio.
• Marketing & Add-Ons: Custom marketing packages including websites, social media management, ad campaigns, newsletters, and more. Priced based on a custom scope of work.

3. Add-On Services

The following services are available as add-ons and are not included in base package pricing unless explicitly stated:

• Distribution: $50 per episode. Includes posting to platforms (Spotify, Apple Music), episode descriptions, SEO optimization, thumbnail creation, and title selection.
• Episode Clips: $50 per episode. Social-media-ready clips created from your recorded episode.
• Animated Intros & Outros: Priced separately per project (included in the Pod Launch package only).
• AI Enhancements: Voice cloning, sound effects, animations, and other AI-powered enhancements are available and priced per project.
• Extra Revisions: 1 to 2 revision rounds are included with each edited episode. Additional revisions are $50 per revision.
• Extra Guests: $50 per additional guest beyond the first 2 included in a session (up to 4 guests total).
• Extra Studio Time: $150 per additional hour beyond the included 1-hour session.

4. Scheduling & Availability

• Sessions must be booked at least one (1) week in advance.
• All sessions are scheduled on a first come, first served basis. We recommend booking as early as possible to secure your preferred date and time.
• We offer a free 30-minute studio tour and consultation by appointment. Contact us to schedule.
• We reserve the right to reschedule sessions due to unforeseen circumstances. Clients will be notified as soon as possible in such cases.

5. Turnaround Times & Delivery

Standard turnaround for edited episodes is approximately two (2) weeks from the date of recording. This is an estimate, not a guarantee.

Turnaround times are subject to change based on:

• Project complexity and scope
• Number of client-requested revisions
• Current production volume and scheduling
• Availability of required assets from the Client

We will communicate any expected delays and keep you informed throughout the production process.

6. Revisions

Each edited episode includes 1 to 2 rounds of revisions at no additional charge. Beyond the included revision rounds, additional revisions are billed at $50 per revision. Revision requests must be clearly communicated in writing (email or message).

7. Refund Policy

All services are non-refundable once production work has begun or deliverables have been provided.

We invest significant time, labor, and resources into every project, including recording, editing, post-production, and creative work. Once these efforts have been applied to your project, we are unable to offer refunds.

This policy applies to, but is not limited to:

• Completed recording sessions
• Episodes that have entered the editing or post-production phase
• Pod Launch deliverables (intros, outros, websites, social media setup)
• Marketing work that has been initiated
• Any custom work performed on the Client's behalf

We encourage all clients to review package details, ask questions, and discuss expectations before booking. If you are unsure about a service, we recommend scheduling a free studio tour and consultation first.

8. Payment

• Payment is due at the time of booking unless otherwise arranged.
• Season packages and custom projects may be eligible for payment plans at our discretion.
• All prices listed on our website are subject to change. The price in effect at the time of your booking is the price you will be charged.

9. Client Responsibilities

• Clients are responsible for arriving on time to scheduled sessions. Late arrivals may result in a shortened session without adjustment to pricing.
• Clients are responsible for providing any required materials, assets, or content in a timely manner. Delays in providing materials may affect turnaround times.
• Clients are welcome to bring their own props, decorations, or branded items to customize the studio set. Clients are responsible for any items they bring.

10. Intellectual Property & Content

Clients retain full ownership of their podcast content, ideas, and intellectual property. HV Podcasting retains the right to use clips, photos, or references to work produced in our studio for promotional purposes (portfolio, social media, website) unless otherwise agreed upon in writing.

11. Studio Set & Equipment

Our studio set is customizable and may be reconfigured between sessions. While we strive to maintain consistency, the exact set configuration may vary. Clients are welcome to request specific setups in advance. Clients are responsible for any damage to studio equipment or property caused during their session.

12. Limitation of Liability

HV Podcasting is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific service in question. We are not responsible for the performance, reach, or success of any podcast, marketing campaign, or content produced, as results depend on many factors outside our control.

13. Cancellations & Rescheduling

• Cancellations made more than 48 hours before a scheduled session may be rescheduled at no additional charge.
• Cancellations made within 48 hours of a scheduled session may be subject to a cancellation fee.
• No-shows will be charged the full session rate.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
